Dutch prosecutors have recommended four and a half years in prison and a seven-year driving ban for Juan C.S., the Spanish truck driver behind the tragic crash that killed seven people, including an unborn child, at a community barbecue in Nieuw-Beijerland on August 27, 2022.
The Public Prosecution Service (OM) delivered the sentencing request during court proceedings on Wednesday, citing the driver’s long history of epilepsy, drug use, and failure to follow medical guidelines as contributing factors in the fatal accident. Another seven people sustained injuries during the crash, which turned a joyful gathering at the local ice club into one of the country’s most devastating road tragedies in recent memory.
“Incredible Risks” Led to Unimaginable Consequences
Prosecutors accuse the 48-year-old driver of knowingly endangering lives by operating a vehicle despite being medically unfit to do so. Juan C.S. had a decades-long history of epilepsy and had previously been warned by medical professionals and fined multiple times for drug-related driving offenses.
“The suspect took incredible risks by driving the truck, and these risks manifested themselves on an enormous scale on August 27, 2022,” said the lead prosecutor in court. “This was not an unfortunate accident, but the result of a deliberate disregard for public safety.”
According to the OM, C.S. failed to take his prescribed medication, misrepresented his medical history, and had used cocaine within 48 hours of the accident. He reportedly suffered an epileptic seizure moments before veering off a dike and plowing into the crowd at a speed of 31 kilometers per hour. Forensic investigators found that the truck had come to a halt before accelerating directly into the partygoers. Most victims died instantly.
No Remorse, No Responsibility
During last week’s hearing, C.S. denied having an epileptic seizure at the time of the crash, contradicting earlier statements he made to police. Prosecutors criticized him for failing to accept responsibility, saying his evasive behavior shows a disturbing lack of accountability.
“Saturday, August 27, 2022, is etched in the memory of so many as a pitch-black day,” the prosecutor said. “All of this was caused by the actions of the suspect, who has not taken responsibility in any way.”
The OM emphasized that the proposed sentence — the maximum legally permissible under current law — reflects the severity of the consequences and the preventable nature of the incident.
Families Call for Justice
Relatives of the victims responded to the sentencing request with measured approval. Their attorney, Yvonne van der Hut, said the prosecution’s demand was “appropriate,” but noted that the families had hoped for a lifelong driving ban.
“They hope that this punishment will be imposed. During that punishment, the suspect can think about what he has done,” Van der Hut stated.
Defense to Respond
The trial continues Thursday with arguments from the defense. Legal observers anticipate a focus on the driver’s mental and medical condition at the time of the crash, as well as challenges to the timeline of drug use and seizure activity.
